Learn about the position of the Superintendence of Industry and Commerce of Colombia and the reasons behind it and the guidelines issued by INDECOPI on this matter based on the cases brought before the authority.

The module will analyze the resolutions issued by the trademark office of Ecuador that dealt with the cancellation of a trademark registration due to vulgarization, specifically the Bizcotelas case and the criteria issued by the TJCA; likewise, a comparison will be made with analogous figures in other legislations, to establish the merits of a claim according to them.

The figure will also be analyzed in the light of a relevant precedent that occurred in Argentina.

The recent and most important resolutions issued by the U.S. courts on trademark matters will be analyzed.

The recent and most important decisions issued by the competent Brazilian trademark authorities will be analyzed.

The module will address various case law decisions related to Trademark Law issued by the Court of Justice of the Andean Community.

The origin of the cancellation action of a notorious trademark will be examined in light of the decision of the Administrative Registry Court of Costa Rica analyzing vote 0116-2022.

The session will be completed with the position adopted by the Court of Justice of the Andean Community on the subject.

How this conflict has been addressed by the Paraguayan and Chilean offices.

This module will explain the recent decision of the TJCA that addressed the analysis criteria that must be followed for the analysis of the distinctiveness of three-dimensional trademarks and color trademarks: Preliminary Interpretation of the TJCA of CAN 160-IP-2020 and CAN 120-IP-2021.

The session will also address the criteria that led the Mexican office to grant novel color trademarks and other non-traditional trademark categories, which are attracting more trademark owners where they find an opportunity to distinguish themselves from their competitors.

This module will address the issue of trademark infringement on the Internet based on the rulings issued by the Court of Justice of the European Union that have already marked an interpretative line in the old continent.

The module deals with the Argentine ruling in the criminal proceeding on two people related to the \\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\"SANIMIAU\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\" and \\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\"LAGER PREMIUM\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\" trademark and the interrelation between Trademark Law, contracts and commercial relations and some cross-border aspects that were very relevant in this case (The Pérez and Westphalen case).

The most recent and original positions in relation to trademark infringements adopted by the Specialized Court on the matter, which is based at the SIC, will also be presented.
