This session aims to provide practical tools to define an appropriate protection strategy when an innovation includes formal elements that may fall under:
– Industrial Design (protection of ornamental form),and/or
– Utility Model (protection of form with a technical function).

The focus will not be placed exclusively on the novelty requirement, but primarily on the substantive requirements that define the essence of each regime:

– Form dictated by function vs.
-Form as an ornamental expression

The legal and strategic criteria for opting for one form of protection, the other, or both (dual protection) will be analyzed.
