The regulation of acquired distinctiveness, supervening distinctiveness or secondary meaning, as it is known in English, is different in all jurisdictions, which is why the ASIPI Trademark Committee, in 2020, set out to analyze it.
In this document we will present a comparative study on the legal treatment of the distinctiveness acquired in different legislations based on a series of questions.
