Trademark law in Uruguay grants the owner of a registered trademark exclusive use and, consequently, the power to prevent others from using or registering trademarks similar or confusing to the one previously registered. The aim is to avoid confusion between products or services. , on its origin, provenance, etc., in order to protect not only the rights of the trademark owner, but also the interests of consumers who will later acquire those products or services. The “trade dress”, the appearance of the product, plays a very important role in the issue of confounding. In Uruguay, there were two relevant judgments on the subject issued in the Civil sphere.
