The Court of Justice of the Andean Community issued ruling 227-IP-2023, in which it analyzes the alleged dominant position of a collective management society and the potential discriminatory practice of applying differentiated fees to economic operators. The ruling raises a series of key questions and their corresponding answers, which will be examined from the perspective of both collective management and competition law.
