Webinar: Does Online dispute resolution (ODR) apply to intellectual property disputes?
Our invited experts will answer some questions such as: What Intellectual Property disputes can be resolved via mediation, conciliation or arbitration? How to write IP dispute resolution clauses to include them in our contracts? What is a neutral third party? How do we ensure that confidentiality is applied in these alternate methods? How is a mediator appointed, what is their role? How does a mediation end, what are its costs, how long does it take, how are the agreements executed? Are the New York Conventions on Enforcement of Awards and the Singapore Conventions on Settlement Arrangements Resulting from Mediation applicable to IP disputes?
Online Mediation, Conciliation and Arbitration are effective tools to resolve different contractual conflicts (licenses, research and development, distribution, franchise, joint venture, etc.) as well as non-contractual ones.
This webinar will serve to promote the use of these alternative online media for cases of intellectual property disputes. We will address practical issues that arise in telematic mediation and the opportunities created by COVID-19. We will explain how they work and we will put examples of real cases that the WIPO Arbitration and Mediation Center has had, as well as other arbitration centers, and we will offer the tools that are currently available to develop them.
