DESCRIPTION:Our invited experts will answer some questions such as: What Intellectual Property disputes can be resolved via mediation\, conciliation or arbitration? How to write IP dispute resolution clauses to include them in our contracts? What is a neutral third party? How do we ensure that confidentiality is applied in these alternate methods? How is a mediator appointed\, what is their role? How does a mediation end\, what are its costs\, how long does it take\, how are the agreements executed? Are the New York Conventions on Enforcement of Awards and the Singapore Conventions on Settlement Arrangements Resulting from Mediation applicable to IP disputes?\nOnline Mediation\, Conciliation and Arbitration are effective tools to resolve different contractual conflicts (licenses\, research and development\, distribution\, franchise\, joint venture\, etc.) as well as non-contractual ones. \nThis webinar will serve to promote the use of these alternative online media for cases of intellectual property disputes. We will address practical issues that arise in telematic mediation and the opportunities created by COVID-19. We will explain how they work and we will put examples of real cases that the WIPO Arbitration and Mediation Center has had\, as well as other arbitration centers\, and we will offer the tools that are currently available to develop them.

DESCRIPTION:Every day we see how restrictions are being applied to the use of trademarks to identify goods and services. It started with limiting the advertising of tobacco products; it continued with the limitation of the imposition of designs on these products and has continued with the generic packaging in which the brand practically disappears. More recently\, restrictions have been placed on the use of trademarks and designs on certain sugar-containing products. This is a worldwide trend and it has become more acute recently. Somehow\, without scientific support\, it is thought that limiting the brand will limit or regulate the consumption of certain foods. Allusion is made to a clash of rights\, between property and health. The idea of the webinar is to discuss the effects of these restrictions and verify their impact on the object that is intended with said measures.

DESCRIPTION:Why having your trademark registered in China is essential even if your company does not commercialize its product in the Chinese market?\nFor many foreign companies China keeps playing a crucial role on the production chain of their products.\nUsually\, these companies have their goods manufactured in this country by an Original Equipment Manufacturer (“OEM”) and then have them exported for its commercialization overseas only.\nIn this scenario\, some of those companies may be tempted to think: why should I spend money protecting my brand or technology in China if the Chinese market is not relevant for my products?\nTo answer that question\, we will evaluate the scenario in light of the past and the most recent decisions from the Supreme People’s Court (“SPC”) regarding OEM activities and trademark infringement.\nIndeed\, when goods are manufactured in China by an OEM with the only intention to have those goods exported overseas\, the foreign buyer is not always the owner in China of the trademark affixed to the goods.\nIn fact\, usually that trademark or a very similar one is registered in China by a third party and such third party may be willing to sue the factory for trademark infringement and stop the exportation of the goods.\nThis is a long-debated question to which the courts have demonstrated different understandings in last years.
