DESCRIPTION:Nuestros expertos invitados responderán algunas inquietudes como: ¿Qué disputas de Propiedad Intelectual pueden resolverse vía mediación\, conciliación o arbitraje? ¿Cómo redactar cláusulas de solución de controversias de P.I. para incluirlas en nuestros contratos? ¿Qué es un tercero neutral? ¿Cómo asegurarnos de que se aplique la confidencialidad en estos métodos alternos? ¿Cómo se nombra a un mediador\, cuál es su rol? ¿Cómo termina una mediación\, cuáles son sus costos\, cuánto tiempo demora\, cómo se ejecutan los acuerdos? ¿Son las Convenciones de Nueva York sobre ejecución de laudos y la de Singapur sobre acuerdos de transacción resultantes de la mediación aplicables a controversias de PI?\nLa Mediación\, la Conciliación y el Arbitraje en línea constituyen herramientas eficaces para solucionar distintos conflictos contractuales (licencias\, investigación y desarrollo\, distribución\, franquicia\, joint venture\, etc) así como no contractuales. Este webinar servirá para promover la utilización de estos medios alternos en línea para los casos de disputas en materia de propiedad intelectual. Trataremos cuestiones prácticas que se plantean en la mediación telemática y las oportunidades creadas por el COVID-19. DESCRIPTION:Cada día vemos como se están aplicando restricciones al uso de marcas para identificar bienes y servicios. Comenzó con limitar la publicidad de productos derivados del tabaco; siguió con la limitación de imposición de diseños a dichos productos y ha seguido con el empaquetado genérico en el cual la marca prácticamente desaparece. Más recientemente\, se han comenzado a imponer restricciones al uso de marcas y diseños en ciertos productos con contenido de azúcar. Esto es una tendencia mundial y se ha agudizado recientemente. De alguna forma\, sin un sustento científico\, se piensa que limitar la marca va a limitar o a regular el consumo de ciertos alimentos. Se hace alusión a un enfrentamiento de derechos\, entre el de la propiedad y el de la salud. La idea del webinar es discutir los efectos de estas restricciones y verificar el impacto de las mismas en el objeto que se pretende con dichas medidas. \n

DESCRIPTION:Why having your trademark registered in China is essential even if your company does not commercialize its product in the Chinese market?\nFor many foreign companies China keeps playing a crucial role on the production chain of their products.\nUsually\, these companies have their goods manufactured in this country by an Original Equipment Manufacturer (“OEM”) and then have them exported for its commercialization overseas only.\nIn this scenario\, some of those companies may be tempted to think: why should I spend money protecting my brand or technology in China if the Chinese market is not relevant for my products?\nTo answer that question\, we will evaluate the scenario in light of the past and the most recent decisions from the Supreme People’s Court (“SPC”) regarding OEM activities and trademark infringement.\nIndeed\, when goods are manufactured in China by an OEM with the only intention to have those goods exported overseas\, the foreign buyer is not always the owner in China of the trademark affixed to the goods.\nIn fact\, usually that trademark or a very similar one is registered in China by a third party and such third party may be willing to sue the factory for trademark infringement and stop the exportation of the goods.\nThis is a long-debated question to which the courts have demonstrated different understandings in last years.
