The MICKEY case in Paraguay

Anyone who hears the term MICKEY or sees the head of the famous mouse, associates these two with DISNEY, anyone but a Paraguayan. This is because in Paraguay there is a registered trademark called MICKEY with the figurative element of the character's head. The brand protects the range of products from class 29 to 33, plus the category of services of class 43.

The big question is how could a trademark registration be granted whose name and logo are so inherent to a company that it has nothing to do with the applicant? The answer is most likely to be found in the legislation in force at the time of the first trademark registration, which, by the way, does not belong to DISNEY.

Despite the immense difficulty in accessing the documents that make up these cases, an approach to them will be attempted from the study of the judgments of the Supreme Court of Justice and the Court of Accounts.
