Mediation is a conflict resolution mechanism in which an impartial third party seeks to facilitate communication so that the parties are
capable of resolving a dispute themselves.
Mediation is having an impressive boom in the global context because it allows solving conflicts in a more agile and economical way than in a litigation process and therefore, the INTA –International Trademark Association–, the world’s largest organization in intellectual property and ASIPI – The nteramerican Association of Intellectual Property–, have been promoting a campaign to train their members with the best practices on the matter.
This work is the result of that interest and contains valuable information on the needs and implications of the reflective practice of ediation. The contributions and contributions made by the authors account for a set of capacities, abilities and skills that are required for a third party, known as a mediator, to carry out an optimal professional work.
