Workshop: The use of copyright in trademark proceedings and unfair competition as a residual action against the infringement of IP rights.

The objective of the workshop is to analyze fundamental and complementary arguments in IP conflicts. On one hand, the use of copyright as a primary or complementary defense in trademark proceedings will be examined. Additionally, new trends regarding the configuration of unfair competition cases in Latin America will be explored, seeking common elements across different legal systems to establish claims and defenses, and to determine under which circumstances they can be used as a residual action alternative when other IP rights do not provide sufficient grounds.
