Patent usurpation action in a bill in Chile

This webinar was held on June 17 with the aim of perfecting the Industrial Property system in Chile; a bill is being processed that modifies Law 19.039 on Industrial Property. One of the modifications introduced is the patent usurpation action, which regulates the right of the legitimate owner of a patent to request the transfer of the registration (and the corresponding compensation for damages), when said patent has been registered by someone who is not entitled to do so. With this webinar we wanted to explore the historical, legal and constitutional reasons for its inclusion as well as the legislation and jurisprudence of the Andean Community.

Margarita Castellanos, Noëlle Jeanneret and Esteban Figueroa were the speakers and Carmen Paz Alvarez and Flavio Belair were the moderators.

With this webinar it was made clear that the patent usurpation action is a welcome inclusion since it updates the Chilean legislation.
