The presentation will address the essential requirements for the protection of designs in the sports context, including the criteria of novelty and individual character, as well as the inherent tension between technical functionality and protectable ornamental features. Emblematic litigation cases involving designs in the industry will be analyzed. Finally, the intersection between design protection and other complementary forms of intellectual property—such as three-dimensional trademarks and trade dress—will be explored.
