DENAE FORUM: FAIR USE: the importation of legal figures outside the Acquis Communautaire and its consequences. Data mining, NFT’s and other situations affecting Copyright”.

Fair use is a creation of American copyright law, which has been shaped and built up by an abundant and complex jurisprudence. Equated, or perhaps confused, with fair use, it causes a certain fascination among some professionals, and even some courts of law. However, in Europe, we have endowed ourselves with an acquis communautaire and it is not known if our rules fit well with this figure. Some current situations have put it back on the table so it is a good time to analyze its fit and possible “import” to the European scenario.

The event will be presented and moderated by Javier Fernández-Lasquetty, who is also president of the Intellectual and Industrial Property Section of ICAM and partner of Elzaburu, and will feature the following panelists:

Ignacio Garrote Fernández-Díez, Professor of Civil Law at the Universidad Autónoma de Madrid. Co-director of the Master in Intellectual, Industrial Property and New Technologies of the UAM.
Clara Ruipérez de Azcárate, Director of Legal Strategy for Content, Trademarks and Digital Transformation at TELEFÓNICA and Secretary of the Board of Directors of M+.
